WEIRTON -- The historic Rosemont Manor in Weirton has become a controversial bed and breakfast since Judge Art Recht ordered it to be shutdown. A controversial website, advertising alternative lifestyle parties, among other things was apparently deemed inappropriate for this area.
However, could this facility soon re-open?
Rose Susko, Rosemont Manor owner, proved Friday that the website which the Judge wanted removed is down.
Judge Recht seemed satisfied.
7 News has even seen documentation which shows Susko no longer owns the site.
However, attorneys for the city of Weirton say she is still advertising, even though she has been shutdown. They claim she called a restaurant owner asking to place a flyer on his bulletin board. A charge Susko flat out denies.
Susko said, “There was an affidavit filed saying I contacted this person, when I have not. Absolutely not!”
Judge Recht tells me that if Susko no longer owns the sites and isn't advertising, that he believes she would be in compliance and could even re-open until other issues are settled.
“I proved today that what the city presented was false. The web site is not up. There is information being advertised.” Susko added.
The ultimate issue surrounds what Susko can use the mansion for.
She wants to operate a bed and breakfast and allow weddings on the grounds, but city leaders seem restrictive when it comes to those types of issues.
“She's operating a business in a residential area. We've given limited exceptions as to what can occur within that business. As long as she or anyone else complies, we have absolutely no problem with her or anyone else operating there. We don't want to shut the business down.” Weirton Attorney Vince Guerra said.
Susko hasn't been able to open all winter and it has devastated her financially. She said she even wants to open up the mansion for historic tours. However, she feels that city leaders can’t do that because of zoning.
The judge has ordered both sides back into court on April 25th at 8:30 a.m.
