STEUBENVILLE, Ohio -- An investigation is underway to determine how pictures of naked middle school students ended up on a janitors cell phone.

Steven DeSimone, a former custodian at Harding Middle School in Steubenville, is now facing pandering obscenity and desiminating charges.

Investigators tell 7 News that DeSimone allegedly had several naked pictures on his cell phone and that he was showing them to other students.

Cpt. Joel Walker of the Steubenville Police Department said, "We discovered the pictures on his cell phone and we know that he was showing them to at least one other person."

The Superintendent of Steubenville City schools didn't want to go on camera to talk about the matter. He would only say that DeSimone has been ordered to stay away from the school and that Desimone has resigned his position.

But it's still unclear as to who took the pictures and how they got on Desimone's phone.

DeSimone faces up to 9 years in prison and thousands of dollars in fines if he is found guilty.

Investigators said so far, he has cooperated with the investigation and his bond has been set at $5,000.

Attorney Steven Stickles was appointed to defend him. A preliminary hearing is set for December 16th at 10am. He has been ordered to stay away from the school.

everyone has their own opinions on this whole situation but if you actually read the information that is given out up to date,there is another man involved in this matterwho had the topless pics on his phone who accidently sent them to desimone's phone.on the other hand,the female juveniles who took the topless pics should be prosecuted as well as desimone and the other man!!!!! he did not rape anyone they was just pics that he recieved on his phone.you can't stop anyone from sending picture messages to another phone but yes he shouldn't have showed them to other students.know all the details before you have something to say!!!!!!!!!!

People like him and those preying on children should go to jail for life and there they can be the victims. I hate them and that is sad but being a father and grandfather i am scared to death for my graandkids. I worry a lot and watch them like a hawk. It looks like our world is going to hell in a hand basket.

why don't they do back up checks on these people ? The schools were safe at one time and now you can't trust the teachers.

I say fry him. Who knows what else he has done. 9 years just isn't good enough. Plus he's probably out on 5,000 bond. What a joke. Maybe the parents will tend to him.

Charge and convict all of them. Not one of them, not two of them, every one of them. It should be dealt with like a killer iceberg. Remove the tip, a new tip surfaces, remove it and so on til it is gone. Another reason phone cameras should be banned from schools and the like.

Your gonna actually defend the janitor. That's diguisting. He shouldn't of had them on his phone regardless anyway. Even if she did take pics of herself or himself. Why would this janitor give his number to the kid anyway? Think about it. That is very wrong.

This society has become so perverse that maybe we should tear down everything and start from scratch. Nude picture on the janitors phone, auto bail out crashing, no relief for mortgage holders, what is this country coming to?

Who says it was a girl? The article clearly avoids saying the sex of the one in the pics... it could also be multiple persons in the photos... it does say students, not student.... but reguardless of how the photos were acquired, the janitor should have known better and deleted them from his phone...

Who said she took the pictures of herself? Maybe, just Maybe he took them while spying on the children. How can you defend and adult showing pictures of naked students to other students?

The little tramp that took pictures of herself naked should go to Juvie Hall; why is it always someone that takes the blame. Nine years possible for what?
