The former assistant prosecutor in Hancock County that has been charged in connection with a fatal heroin overdose is expected to appear in court Tuesday morning.
Weirton attorney Don Humberson is charged with battery and possession of a controlled substance.
Weirton Police Chief Bruce Marshall said Humberson went to Steubenville last May and purchased ten bags of heroin for himself and two other men. One of those men, Scott Roach, later overdosed. He died in a hospital a few weeks later.
To avoid conflicts of interest, Hancock County Magistrate Scott Hicks has turned the case over to Ohio County Prosecutor Scott Smith.
