Alpha Natural Resources and Mountain State Carbon have settled a lawsuit over a coal supply contract.
Terms of the settlement weren't disclosed.
The Associated Press reports the two sides notified Brooke County Circuit Court Judge Ron Wilson about the agreement late Sunday. The lawsuit had been scheduled to go to trial Monday.
Mountain State Carbon sued a Massey Energy subsidiary, Central West Virginia Energy Co., in 2011. Virginia-based Alpha acquired Massey in 2011.
The lawsuit claimed Central West Virginia Energy sold metallurgical coal in export markets instead of supplying it to Mountain State Carbon's coke-making operations in Follansbee. The export markets brought higher prices than Mountain State Carbon would have paid under the coal supply contract.
