Corrections officials are proceeding as if Donald Palmer will still be executed by lethal injection on Sept. 20.
The Belmont County convicted double murderer still has a chance at least to push back the date, according to Prosecutor Chris Berhalter.
Palmer was convicted for the murders of Steven Vargo and Charles Sponhaltz on Deep Run Road in 1989. The incident started as a case of road rage, leading Palmer to shoot both victims in the head.
The Ohio Parole Board voted unanimously to deny Palmer clemency.
Palmer's co-defendant Edward Hill was also convicted of the murders. He received 35 years to life and is still in prison.
