The producer of Twinkies and Ding Dongs will head to bankruptcy court Wednesday morning.
A judge will decide if Hostess can liquidate their company.
Talks between the company and its second biggest union broke down Tuesday with no agreement reached.
The talks had come as a surprise after Hostess declared last week it would move to close its business and start selling off its assets in bankruptcy court.
The judge noted that 18,000 jobs are on the line and urged the company and union to try to resolve their differences.
Other companies are reportedly interested in buying some of Hostess' more popular brands.
