HUNTINGTON, WV (AP) — A Huntington tax that's facing a court challenge has been repealed.
Media outlets report that City Council voted unanimously Monday to repeal the 1 percent occupation tax.
The
council approved the tax in 2011 to replace the city's user fee. It was
part of a tax reform package stemming from Huntington's participation
in the state's home rule experiment, which gives more power to
municipalities.
A lawsuit challenging the tax's legality is
pending in Kanawha County Circuit Court. Plaintiffs include Steel of
West Virginia and Cabell County Commissioner Bob Bailey. An injunction
issued in the case blocked the tax from going into effect.
