WV Supreme Court rejects appeal in 1991 murder case

Posted: Updated:

CHARLESTON, W.Va. (AP) — The West Virginia Supreme Court says a Kanawha County court judge did not err in accepting a murder plea for a man who admitted to beating and strangling another man to death with his shoelace.

John Alan Boyce pleaded guilty in 1992 to first-degree murder charges linked to the death of Frank Stafford, of Loudendale.

The year before, Boyce and another man got into an argument with Stafford that prosecutors said eventually led to Stafford's death.

Boyce argued that his plea should've been thrown out because a judge found several years later that police had lacked probable cause to arrest the other man.

In a ruling released Thursday, the Charleston Gazette reports (http://bit.ly/15kgyHk) that the high court pointed out that the judge went over the ramifications of Boyce's plea.
