A few weeks after the Ohio Valley Mall Company announced a new Asian inspired restaurant would be coming to the mall, it was discovered the new eatery could violate the terms of a current lease with an established restaurant.
According to Osaka Steakhouse, bringing the new restaurant "Panda" into the mall violates a restrictive covenant in the steakhouse's lease with the Ohio Valley Mall Company. A press release from Attorney Christopher Gagin, Osaka's lease at the Ohio Valley Mall includes a provision that "strictly prohibits any quote "Chinese or Japanese" restaurant in the "mall area."
Last month, the Ohio Valley Mall Company, which owns and manages the mall with the Youngstown based Cafaro Company, announced the new restaurant scheduled to open in November in the former Quiznos building. Describing it as an "Asian Fusion," Gagin states in the notice that the opening of this restaurant would devastate his client's bottom line. Now, he is asking the mall to provide him a written response by the end of business on September 13.
