Councilman Domestic Battery Trial Set for January in Harrison County

A Clarksburg councilman accused of a misdemeanor domestic battery charge involving his wife appeared in Harrison County Magistrate court Monday for a motion hearing.

Sam "Zeke" Lopez, represented by Gregory Schillace, filed several motions in the case, which stems from an April 2 incident where Clarksburg police responded to Lopez's home in Clarksburg for a domestic call. Linda Lopez told officers that she and her husband, Sam Lopez, were involved in a verbal argument that turned physical, according to the criminal complaint. Linda Lopez told officers that her husband grabbed her arm and pushed her to the ground.

Schillace filed a motion to exclude prior incidents of domestic violence involving Lopez as evidence, which Magistrate Tammy Marple approved.  Other motions included to preclude testimony that this domestic incident wasn't prosecuted based on Lopez's political influence. Magistrate Marple denied that motion, according to court filings. Schillace also filed a motion to exclude Linda Lopez from testifying at the trial, which Magistrate Marple also denied.

Magistrate Marple set a jury trial date for January 14. She anticipates the trial will last about three days.

Marion County Prosecuting Attorney Patrick Wilson is the special prosecutor on the case.
