The man who was put behind bars after rolling his truck over on Interstate 70 that led to the death of his girlfriend had the felony charges against him dropped Wednesday.
James Andrew Beal told officers he had been drinking the night before, but not the morning of the crash.
The prosecutor’s office said after sending a reconstruction team to the scene, they felt they could not prove their case against Beal.
The felony charges against him were dropped, and he is now facing a misdemeanor DUI offense, proximately causing death.
If found guilty he faces from 90 days to one year in jail, and a fine between $500 and $1,000.
Magistrate Harry Radcliffe remanded him back to jail, under $10,000 bond on the misdemeanor offense.
