In Bizarre Twist, Convicted Murder Requests Prosecution Takes Stand in New Trial

In a strange turn of events, the defense for a man convicted of killing his paraplegic girlfriend 15 years ago is asking for the prosecuting attorney to take the stand in a new trial   

Defense attorney for Yasser Abdelhaq is asking that Ohio County Prosecutor Scott Smith take the stand and testify.

Abdelhaq was found guilty of the first-degree murder of Dana Tozer of Lakewood in 2004. Tozer’s body was found in a hotel in Wheeling with more than 230 stab wounds in 1999.

Abdelhaq made the request for a new trial in December 2014. He is currently serving a life-sentence at the Mt. Olive Correctional Facility in southern West Virginia.

The request to subpoena Smith is scheduled for 2 p.m. Monday in from of Judge James Mazzone.
