A John Marshall High School teacher charged with possessing child erotica has been suspended from his job indefinitely.

David Duane Will, Jr., who had been accused of making unwanted advances against a female student earlier this year, pleaded guilty to battery charges in August, and was promptly re-arrested by police on the child erotica charges. On Tuesday, the Marshall County Board of Education placed Will on indefinite unpaid suspension pending the outcome of the new case.

In a criminal complaint filed in April of this year, a female student said she reported to the school’s resource officer that on April 9, Will, Jr., 33, allegedly attempted to embrace and kiss her when she was sent to Will’s classroom on an assignment to take photos for the school’s yearbook.

According to the criminal complaint, the girl told police Will had previously contacted her via Facebook and Twitter with messages that made her uncomfortable, and she was hesitant to go to the classroom fearing Will would be there alone. She then asked her older sister to accompany her to the classroom. Upon arrival at the classroom, the girl noted there were other students in the room. As she entered the room, Will allegedly said to her, “What do you need beautiful? I’ve missed you.”

The girl then said she attempted to ignore the comments and began to take photos of the class. It was at this time that Will allegedly moved toward her and attempted to embrace and kiss her, to which the girl said she immediately turned away from, with Will’s kiss landing on her cheek. The girl immediately left the room and reported the incident to the school’s resource officer. She then told police Will continued to contact her via social media, the messages to which she ignored.

According to the complaint, Will had previously been reported to the Marshall County Board of Education for a similar incident.
