A driver charged in a crash that killed a 2-year-old boy has been found not guilty by a West Virginia jury.

The Bluefield Daily Telegraph reports 51-year-old Michael Dicker was acquitted Thursday in Mercer County court. Ayden Jayce Knight had left his home nearby when he was fatally struck on a highway in September.

Dicker was indicted on two charges: leaving the scene of an accident causing death and obstructing an officer.

Dicker’s attorney, Ryan Flanigan, says the Bluefield resident did not know what his van struck and thought he hit a deer because he was driving through a rural area.

Prosecutor George Sitler says it was inexplicable the child came running into the road that evening, but Dicker told investigators he did not see anything because he was in denial.
